This Affiliate Agreement ("Agreement") is entered into by and between R & C Enterprises Pty Ltd, trading as Digital Freedom Framework (the "Company"), and the individual or entity ("Affiliate", "you", or "your") who applies to promote and resell the Company’s digital products under this program. By enrolling or participating in the affiliate program, you agree to be bound by the terms and conditions set forth herein.

1. Program Overview

The Company provides an affiliate program whereby approved affiliates may promote the Digital Freedom Framework course and earn a 50% commission per sale through their unique affiliate link. Participation is entirely optional, voluntary, and subject to this Agreement.

2. Eligibility

To participate in the affiliate program, you must:

Be at least 18 years of age

Own a valid email address and payment account

Not promote content that is defamatory, unlawful, unethical, or harmful

Be an active or past student of the Digital Freedom Framework

The Company reserves the right to accept or reject any affiliate application at its sole discretion.

3. Commissions & Payment Terms

You will earn 50% commission on the net sale price of each eligible purchase made via your unique affiliate link.

Commissions are paid after the refund period ends (minimum 14 days post-sale).

Payments are made via PayPal or nominated bank account on a monthly basis, provided a minimum threshold of $100 AUD is met.

If a refund is issued on any referred purchase, the commission for that transaction will be voided or reversed.

4. Tracking & Attribution

Affiliates will be provided with a unique tracking link.

The Company is not responsible for tracking failures due to ad blockers, cookie deletion, customer device issues, or customers using a different device or browser to purchase.

Attribution is based on last-click tracking.

5. Promotional Guidelines

All affiliates are required to uphold the integrity, reputation, and legal standards of Digital Freedom Framework. As an affiliate, you agree to adhere to the following promotional guidelines:

5.1 Honest Representation

You agree to:

Accurately represent the product, pricing, features, and inclusions

Never make earnings guarantees or income claims unless clearly labeled as examples, disclaimers are provided, and you are sharing your own experience

Avoid misleading or exaggerated claims about the results others may achieve

5.2 No Misrepresentation of Role

You may not:

Present yourself as the creator, founder, or owner of Digital Freedom Framework

Imply that the program is your own or that it was developed by you

Rebrand or white-label any portion of the course, funnel, or content
You must clearly disclose your role as an independent affiliate and that the product is owned and operated by R & C Enterprises Pty Ltd.

5.3 Content & Platform Compliance

You agree to:

Follow all marketing and advertising laws, including those related to disclosures and disclaimers in your country

Comply with platform policies on Facebook, Instagram, TikTok, email, and any other promotional channels

Include appropriate affiliate disclosures (e.g. #ad, “affiliate link”) where required
5.4 No Spam or Unethical Practices

You may not engage in:

Spam (unsolicited DMs, mass messaging, fake comments, or bot traffic)

False scarcity or fake testimonials

Paid advertising using our brand name, product name, or any derivative as a keyword (without written approval)
5.5 Respect for Intellectual Property

You agree not to:

Download, edit, or repurpose any of our course content, videos, or documents as your own

Violation of any of the above may result in immediate removal from the affiliate program and forfeiture of unpaid commissions. We reserve the right to take legal action for serious or repeated violations.

Prohibited Activities:

Running paid ads using the brand name (e.g., “Digital Freedom Framework”) without permission

Spamming, misleading tactics, or deceptive advertising

Offering unapproved bonuses or misrepresenting the offer

Using someone else's affiliate link or circumventing tracking

Violation of these guidelines may result in immediate removal from the program and forfeiture of unpaid commissions.

6. Legal Responsibilities

Affiliates are independent contractors, not employees, partners, or representatives of the Company. You are solely responsible for:

Your own business operations, taxes, and legal compliance

Following your local advertising and affiliate laws

Handling disputes or liabilities arising from your marketing activities
7. Use of Customer Data

If you receive customer information (e.g., names, emails) through your affiliate efforts, you agree to:

Treat all data as confidential

Never resell, share, or misuse this data

Only contact leads in a lawful, ethical, and GDPR-compliant manner
Any misuse of customer data will result in immediate program termination and potential legal action.

8. Intellectual Property

All materials, branding, product names, course content, and frameworks remain the sole property of R & C Enterprises Pty Ltd. You may not repurpose, download, or use course materials as your own. Doing so will result in immediate legal action.

You are granted a limited, revocable license to use Company-provided promotional materials solely for the purpose of affiliate promotion.

9. Termination

The Company may terminate your participation in the affiliate program at any time, with or without cause, including but not limited to:

Breach of this Agreement or any linked terms

Misuse of brand, spam, or unethical behavior
You may also terminate your participation at any time by written notice. Upon termination, all outstanding commissions will be paid out per usual schedule (minus any pending refunds), and all affiliate links must be removed immediately.

10. Limitation of Liability

We make no guarantees of income, success, or performance. We are not liable for any indirect, incidental, or consequential damages arising from your participation in this program. You participate at your own risk.

11. Modification of Terms

The Company reserves the right to update or change this Agreement at any time. You will be notified of material changes via email or dashboard. Continued participation after updates constitutes acceptance of the new terms.

12. Governing Law

This Agreement shall be governed by the laws of Victoria, Australia, and any disputes arising hereunder shall be resolved exclusively in the courts located in Victoria.

13. Entire Agreement

This document constitutes the entire agreement between the Company and the Affiliate regarding the program. It supersedes all prior or contemporaneous communications, whether written or oral.

By joining and participating in the affiliate program, you confirm that you have read, understood, and agreed to this Affiliate Agreement.
